Introduction

Nature Rescue app ("Application") is a platform that encourages the use of information technology to report rubbish blackspots and organize terrestrial and coastal cleanup activities. The Application allow transmission, display and share text, image, data and other information, including third party maps ("Maps") (collectively the "Content"). This Application is co-owned by Green Power Limited (“Green Power”) and Sun Hung Kai Real Estate Agency Limited ("SHKREAL")

Green Power and SHKREAL (hereinafter collectively called the “ App Owner”) is not liable and makes no warranties for your use of the Application. Users will be responsible for any risks associated with any activities.

Violating any of the following Terms and Conditions ("Terms") may cause termination to your account.

These Terms, including the terms in our privacy policy ("Privacy Policy"), apply to the use of all services ("Services") rendered by the Application. By downloading, using the Application in any ways, You acknowledge that you ("You" or "Users") have read, understand and agree to be bound by the Terms and the Privacy Policy both of which may be revised from time to time. 

1. Use of the Services

The App Owner hereby grants you a licence to download and use the Application on your mobile device for your own personal viewing and usage. You shall not: (i) copy the interface, design or content of the Application (except for the copies made as required for proper use of the Application function); (ii) modify, adapt, translate, reverse engineer, make alterations, decompile, disassemble or make derivative works based on the Application; and/or (iii) sub-license or attempt to grant other rights to the Application or any part of the Application to third parties.

The Content is owned by the App Owner or other third parties content providers (if any), including other Users, owners of the Maps, and the App Owner's partners, sponsors or affiliates. The Content is under the protection of copyright and shall not be used for any purpose other than those written in these Terms without the prior written consent from the App Owner and/or the relevant owner of the Content. 

The Application utilizes maps licensed by OpenStreetMap and Google Maps under their open license arrangements. All uses of the Maps shall comply with these Terms and all applicable conditions imposed by OpenStreetMap and Google Maps. Please refer to http://www.openstreetmap.org/copyright and https://www.google.com/help/legalnotices_maps/ for more detail. If You violate any of these Terms and/or the OpenStreetMap's and Google Maps’ conditions, your account may be terminated.

The Application is for your own personal use only. The following actions are prohibited: (i) collection of other users’ usernames and/or mobile phone numbers and/or email addresses for the purpose of sending unsolicited email or unwanted communications (except for the usage required for proper use of the Application function), (ii) any action that would degrades the reliability, speed, or operation of the Application (solely judged by the App Owner), (iii) collection of data by any means, without the App Owner’s authorization; and (iv) use of the Application in any way that is unlawful or violates of these Terms.

2. Third Parties Provided Content

All information or data or photos submitted to or shared through the Application and shared and made public by Users ("User Content") is considered to be licensed under Creative Commons license "Attribution-NonCommercial-NoDerivs 4.0". For details, please visit: http://creativecommons.org/licenses/by-nc-nd/4.0/. All User Content that reports blackspot is set as public automatically. User can only set privacy for private events.

You affirm, represent and warrant that all User Content You submitted have obtained necessary permission, rights, consents and/or access to use, and/or authorize the App Owner  to release, share or use the User Content over the Application without infringing any third party's rights.

You shall be solely responsible for the User Content You submitted and the consequences faced by the App Owner as a result of your posting, sharing or use of such User Content. You will not; (i) upload malicious codes, malware, computer virus or other; (ii) post content contain hate speech, discrimination, nudity, or; incites violence, threatening; (iii) use the Application to do any unlawful, misleading or malicious act; (iv) do any act that will render the Application malfunction or impair the normal operation/appearance of the Application; (v) assist or encourage anyone violate the law and/or these Terms.

If your User Content is accused of or found to be infringing a third party’s intellectual property rights or other rights, or in any way violate the law and/or these Terms, the App Owner may remove the content without notice. The App Owner may suspend or terminate your account if the aforementioned behavior continues (solely judged by the App Owner). 

By submitting the User Content over the Application, You are deemed to grant the App Owner a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, distribute, reproduce, produce derivative, modify and show all or part of the content. The App Owner may keep copies of any User content for maintenance, backup, security or legal purposes.  

3. Account and Security

User of this Application should only create one account. User should not create account for others without permission. User should not share account with other users. You should not create account without the App Owner’s permission if your account was suspended/terminated.

User is not allowed to use the Application for commercial gain. This Application targets audiences above 13. If User’s account name and/or profile picture is accused of or found to be imitation of other entity, including but not limited to company, organization, institution, etc., or cause confusion, the App Owner reserves the right to remove or reclaim your account. 

You affirm, represent and warrant that the User Content you provided does not infringe or violate other's rights or violate the law. If You are found to be infringing other’s copyright, your account will be terminated (solely judged by the App Owner). 

User is not allowed to use similar marks including but not limited to “Nature Rescue”, or related logo without written permission.

4. Privacy

By downloading, using or in any other way using the Application, You agree with the Personal Information Collection Statement which is incorporated with this Terms. The Personal Information Collection Statement may update over time without notice. The App Owner can collect and use user’s personal data, mobile device information, Application access information, Application performance and other data transmitted via the Application.

5. Indemnity

You agree to indemnify and hold harmless the App Owner and its affiliates, directors, employees and agents from all claims, actions or demands caused by or resulting from, related to, or incidental to your use of the Application.

6. Disclaimer of Warranty and Limitation of Liability

The App Owner does not guarantee accuracy, completeness and suitability (in any circumstances) of the information provided by the Application. The App Owner holds no responsibility for any mistakes (either expressed or implied) and/or omission for the information provided by the Application. The App Owner and its affiliates, officers, directors, employees and agents shall not be liable for any loss, destruction or damage (include but not limited to consequential loss) arising from or in respect of using, misusing, inability to use or relying on the information.

The App Owner makes no warranty that the Application is free of computer viruses, bugs, error, data interruption and/or delay. The App Owner and its affiliates, officers, directors, employees and agents shall not have or accept any liability, obligation or responsibility.

7. Termination

The App Owner may terminate services and/or user’s account any time without preceding notice. If You are found to be infringing other’s copyright, your account will be terminated (solely judged by the App Owner).

Users may terminate their own account anytime by emailing to info@greenpower.org.hk.

All legal rights and licences granted to User shall be terminated upon account termination. User Content has published on the Application may continue to exist after account termination.

The App Owner holds no responsibility for any offensive, obscene, inappropriate, illegal and/or objectional content published, shared and/or used by User. However, the App Owner reserves the right to remove such content and terminate the relevant user account.

8. Acknowledgement of Understanding

You confirm and warrant that: (i) You agree to bind yourself to this Terms; (ii) You shall use the Application solely for the purposes permitted in this Terms; (iii) You shall comply with all laws and regulations in the Hong Kong Special Administrative Region when using the Application.

9. Governing Law & Jurisdiction

This Terms is governed by the law of the Hong Kong Special Administrative Region. All the terms are applicable independently. If any of these terms deemed to be inapplicable or invalid in any other jurisdiction, the remaining terms shall remain applicable and valid.

10. Amendment of these Terms

The App Owner may amend and modify the Terms over time without notice. User continues to use the Application after these amendment and modification mean that User agree and accept those changes.

PERSONAL INFORMATION COLLECTION STATEMENT

The App Owner committed to protect and respect your ("You" or "Users") privacy and security of the personal information provided when using the Nature Rescue App (“Application”). This Personal Information Collection Statement (“PICS”) is integrated as part of the Application’s Terms and Conditions (“Terms”). By downloading, using the Application in any ways, you acknowledge that you have read, understand and agree to be bound by the Terms and the PICS both of which may be revised from time to time, so please check regularly.

When You sign up for an account with the Application, the App Owner will collect Users’ mobile phone number, email address and other information. Users must provide this information to sign up for the Application. 

The Application will collect User’s GPS data, time, duration and distance (collectively “Location data”) for the following purposes:

  • Record and publish rubbish blackspot submitted by User

  • Record tracking routes of User

  • Record location data with User account

Provision of GPS data is optional for User. If User refuses to provide such data, part of the Application function cannot be used.

The Application will collect User data and aggregate it to acquire information such as the total number of User of the Application, number of usage of a particular function. Only personally non-identifiable information will be used in the process.

Use of Information in Direct Marketing

Without User’s consent, the App Owner would not provide User’s information, Location Data to any third party for marketing or any other purposes. Your consent may be communicated to us without charge at the time when you provide such information through our website or by writing to us. 

Sharing Personal Data

When User submits rubbish blackspot via the Application, content submitted (including Location Data and information of the blackspot, User’s account information, etc.) will be published. Other users can view and share the content.

When User create events via the Application, other users can view events content if events are set as “public”. 

When User records a route with the Application, User can choose whether to publish, share the route, including its Location Data, tracking information, user information.

The Application may provide links to third-party websites. The App Owner holds no responsibility for the terms and conditions and privacy policy of any third-party websites. User should check the terms and conditions and privacy policy of those third-party websites when visiting their websites or platforms.

The App Owner does not knowingly collect personal data from children under 13. Children under 13 should not provide any personal data. The App Owner encourages parents and legal guardians monitor internet usage of their children to assist the App Owner to fulfill this PICS.

Users' personal data will be kept confidential but we may transfer or disclose such personal data to our contractors under a duty of confidentiality to us who provide administrative, telecommunications, computer, data processing or other services to us in connection with management, operation and maintenance of the system with the purpose of personal data collection.

User information will not generally be disclosed or transferred to any other party in a form that would identify them except as follows: 

  • If it is necessary to allow Third Party Service/Product Providers to offer and provide the third party services (“Third Party Services”) chosen by a user in this App and for purposes directly relating thereto.

  • If it is necessary to transfer your personal data to comply with any guideline or guidance of any local or foreign legal, regulatory, tax, government, law enforcement or other authorities.

  • We may also transfer/exchange/disclose your personal data to or with companies within the group of Green Power and/or the Sun Hung Kai Properties Group for internal statistical research and/or analysis.

  • As required or permitted by law.

These parties may have places of business outside Hong Kong, so information may be transferred out of Hong Kong. By subscribing to this App or by logging-in, users agree to transfer information to these parties outside Hong Kong when needed. These parties have their own privacy policies and the App Owner has no control over their use of information, so the App Owner is not liable for their use of information.

Security and Retention of Personal Data

Only employee and agents of the App Owner would view User’s information and Location Data collected on a need-to-know basis. 

Rubbish blackspot submitted and event created will remain and publish in the Application upon termination of User’s account. An archived copy may be retained as required by law or for legitimate business purposes. If you would like to delete or deactivate your account, please contact us at info@greenpower.org.hk.

The App Owner may entrust IT contractor and agents to maintain, enhance and update the Application and provide technical support from time to time. They may process your personal data in the process. Except for this purpose, and save as other provided in this PICS, the App Owner will not disclose or transmit your personal data to a third party without User’s consent.

Security flaw may exist in any system. The App Owner cannot guarantee the security of our databases nor can we guarantee that the information User submit will not be intercepted when being transmitted to and from us over the Internet.

Access to Personal Data

You have the right to request access to and correction of your personal data in accordance with the provisions of the Personal Data (Privacy) Ordinance (Cap.486). Any data access request or data correction request may be made to us at info@greenpower.org.hk. 

If there is any inconsistency or conflict between the English and Chinese version, the English version shall prevail.
